Terms of Service

This document is a starting template, not legal advice. It uses placeholders like [FILL IN: company legal entity] that must be completed, and it should be reviewed by qualified legal counsel before you rely on it.
These Terms of Service (the “Terms”) are a binding agreement between you (“you” or “Customer”) and [FILL IN: company legal entity] (“SocialiQ,” “we,” “us,” or “our”), the operator of the SocialiQ service at https://socialiq.dev(the “Service”). Please read them carefully.
1. Acceptance of these Terms
By creating an account, generating an API key, calling the API, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to that organization. If you do not agree to these Terms, do not use the Service.
2. Description of the Service
SocialiQ provides a unified, normalized REST API that returns public social media data in one consistent shape across multiple platforms, including TikTok, Instagram, YouTube, Reddit, X/Twitter, Threads, and LinkedIn. The Service is intended for developers, AI agents, analysts, and research workflows.
We may add, change, deprecate, or remove platforms, endpoints, fields, or features over time. We will make reasonable efforts to communicate material changes, but we are not obligated to maintain any particular platform coverage, data field, or capability.
3. Accounts and API keys
To use the Service you must create an account and generate one or more API keys, which are formatted like sc_live_.... You are responsible for the accuracy of the information you provide and for keeping your account credentials and API keys up to date.
- Keep your keys secret. Treat your API keys like passwords. Do not embed them in client-side code, public repositories, mobile apps, or anywhere they may be exposed.
- You are responsible for usage under your key. All activity and all charges incurred under your API keys are your responsibility, whether or not you authorized that specific activity. If you believe a key has been compromised, rotate or revoke it immediately and contact us at security@socialiq.dev.
- One identity per account. You must not share accounts, misrepresent your identity, or create accounts through automated means to evade limits or suspensions.
4. Acceptable use
When using the Service, you agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation, including data protection, privacy, intellectual property, export control, and anti-spam laws.
- Use the Service in a way that violates the terms of service, community guidelines, or other rules of the underlying social media platforms whose public data is surfaced through the Service.
- Resell, redistribute, or otherwise make available raw data obtained through the Service in any manner that violates applicable law or any third party’s rights.
- Attempt to identify, de-anonymize, surveil, harass, stalk, or harm individuals, or to discriminate against any person in a way prohibited by law.
- Exceed your plan’s rate limits, circumvent usage controls, or otherwise use the Service in a manner that is abusive, disproportionate, or that degrades the Service for others. Access must be within fair and reasonable use.
- Probe, scan, or test the vulnerability of the Service, breach or circumvent any security or authentication measures, or interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or attempt to derive the source code or underlying data sources of the Service, except to the extent that restriction is prohibited by applicable law.
We may, at our discretion, throttle, suspend, or terminate access that we reasonably believe violates this section, and we may cooperate with platforms and authorities where required by law.
5. Billing and usage-based fees
The Service is offered on usage-based pricing, as described on our pricing page. By using a paid feature of the Service, you authorize us to charge the applicable fees.
- Payment processing. Charges are processed through our payment processor, Stripe. You agree to provide accurate, current, and complete billing information and to keep it updated.
- Usage metering. Fees are calculated based on your metered usage of the Service (for example, billable units or API calls). Our records of usage are the authoritative basis for billing, absent manifest error.
- Taxes. Fees are exclusive of taxes. You are responsible for all applicable taxes, levies, or duties, other than taxes based on our net income.
- No refunds for consumed usage. Except where required by applicable law, fees for usage that has already been consumed are non-refundable. Failure to pay may result in suspension or termination of access.
- Price changes. We may change pricing prospectively. We will use reasonable efforts to provide notice of material pricing changes through the Service or by email.
6. Data and public information disclaimer
The Service returns data that is publicly available on third-party social media platforms, normalized into a consistent shape. We do not control that source data, and we make no representation or warranty that it is accurate, complete, current, lawful for your intended use, or available at any given time. Platforms may change, restrict, or remove content at any moment, which can affect what the Service returns.
You are solely responsible for determining whether your collection, storage, and use of data obtained through the Service is lawful and appropriate for your use case, including obtaining any consents or providing any notices required by applicable law. We obtain underlying data from licensed and third-party data providers.
7. Third-party platforms and independence
SocialiQ is an independent service. We are not affiliated with, sponsored by, endorsed by, or otherwise associated with TikTok, Meta (Instagram, Threads), Google or YouTube, Reddit, X (formerly Twitter), LinkedIn, or any other platform referenced by the Service. All product names, logos, and brands are the property of their respective owners and are used for identification purposes only.
Your use of any third-party platform remains subject to that platform’s own terms, and we are not responsible for the acts or omissions of any third-party platform or data provider.
8. Subprocessors and infrastructure
We rely on trusted service providers to operate the Service, including Clerk (authentication), Stripe (payments and billing), Supabase (database), and Vercel and Railway (hosting). Your use of the Service may involve the processing of data by these providers.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA RETURNED WILL BE ACCURATE, COMPLETE, OR CURRENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SOCIALIQ OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to defend, indemnify, and hold harmless SocialiQ and its officers, directors, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including any platform’s terms; or (d) any data you collect, store, or use through the Service.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, if required by law or by a third-party platform or data provider, or to protect the Service, other users, or third parties.
Upon termination, your right to access the Service ceases. Any fees accrued before termination remain payable, and the sections that by their nature should survive termination (including billing obligations, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice through the Service or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
14. Governing law
